Our White House correspondent Liz Landers has more The ruling allows the administration to proceed with an executive order President Trump signed in March directing the US Postal Service to determine which voters should receive mail-in ballots. It also directs the Department of Homeland Security, to build a database of U.S citizens who are eligible to vote. There are lot of moving parts and here to help explain it all is Steve Flattuck he's a constitutional law professor at Georgetown University Law Center. So there are two lawsuits that are challenging the president's executive order about mail-in ballots, the Supreme Court decision yesterday had to do with a group of states that sued while the other case that was brought by The League Of Women Voters what did the Supreme Court ruling tell the States? Yeah, so the Supreme Court's ruling only applied Liz to the state's lawsuit. And it only said that the states had sued too early because they brought their lawsuit before the US Postal Service issued their final rule which of course they did last Friday. So it was I think a win for President Trump but a very time limited one

It didn't say anything about whether the new Postal Service rule is lawful, that issue is now going to be litigated probably pretty quickly in both of the cases that are back before Judge Talwani and Boston. I have been yeah absolutely and uh...I don't think it's gonna have much effect on Texas because we have pretty strict mail-in ballot rules but I know like my friends out in the West Coast, everybody gets a ballot in their mail. There's just stacks of them out there and there has got to be something between them I have voted by mail before living overseas so have done that In fact one presidential election it must've been 90

This was purely for standing, in other words because the states hadn't been hurt nothing has happened to them so they just jumped the gun and Rob thinks that they won't even be able to bring anything back to the Supreme Court until after the election which is interesting So this seems like one of phenomenal pieces of lawfare done by Republicans for once because it's always the Democrats who have all the lawfare on their side. exactly what the executive order does.

The problem is that's not the job of DHS, they don't have this information, its not their constitutional role, they've also made these ludicrous claims of voter fraud for example they claim 15 thousand people non-citizens

29:00 were registered to vote in Nevada. When a closer look was taken at that data, it turned out 185 non-citizens were registered. Oh and that's okay! It's just 185. It's never wide scale and is never large. It's all just little bits and bobs here and there. So they had dramatically overstated the number of non-citizen voting and that's the fear here is that if voting proceeds based on these DHS lists it's going to be inaccurate, its going to be unconstitutional. I don't see the unconstitutional angle at all Yeah, if they pull up that manner of elections being up to the states and I don't have the exact language but that is in the Constitution. Right but they can still hold their election it's just you can't use the US Postal Service without them being on a list and otherwise go

It's not like they're gonna have to create something new or you know spend years getting it all together just send them the list. And then I guess what DHS is going to do...I guess they have the list of who has US citizenship? I would presume somebody has a list of that somewhere but
